Consignment Agreement Alexaras LLC, dba Bloomingdeals agrees to take consignor’s goods to attempt to sell such goods for the consignor. Consignor agrees to place such goods with Bloomingdeals. The consignors signature below indicates agreement with the following conditions: 1. Consigned items must be in excellent condition and of high quality. All items must be odor free, clean and ready for retail display. Bloomingdeals reserves the right to refuse items that are deemed unsuitable to sell for reasons such as design, style, size, asking price etc. Items determined to be unsellable will be donated unless otherwise stated by the consignor. If consignor wishes to pick up items that Bloomingdeals finds to be unsellable, they must do so within seven days of notification. Items left after 7 days will be donated. 2. The length of consignment shall be 90 days. 3. The consignor shall receive 50% of the actual sales proceeds of all items sold. Bloomingdeals reserves the right to reduce the price of unsold items. Items will generally be reduced by 10% after approximately 30 days, 20% after approximately 60 days and 30% between the 60th and 90th day of the consignment period. Items not sold after 90 days will become the property of Bloomingdeals unless the consignor makes arrangements prior to the 90 day expiration date or re-consigns the item for another 90 day period. Reconsigned items may be further discounted at the decretion of Bloomingdeals……..PLEASE MARK YOUR CALENDAR !!! It is the consignors responsibility to maintain recordsconsigned.4. Consignors may not pick up items prior to the expiration of this agreement without advance notification. Large furniture pieces withdrawn from sale, picked up prior to the expiration date, may be charged a $2 daily fee for each day stored at Bloomingdeals. 5.Bloomingdeals assumes NO LIABILITY for loss,damage or destruction of any item consigned. The Consignor agrees to hold Bloomingdeals harmless for any and all losses or damage without exception. 6. Payment to consignors for their portion of sold merchandise will be made by direct bank deposit (ACH). A fee of 2.00 will apply. 7. Consignors testify that he/she is the lawful owner of any and all goods placed for consignment, and are free of liens, claims or recourse.
